SUPREME COURT DECISION ON MEDICAL NEGLIGENCE

the respondent was suffering from chronic renal failure — referred for kidney transplant — the respondent was undergoing haemodialysis twice a week on account of chronic renal failure. Investigations were underway to find a suitable donor — from 5.6.1991 to 8.6.1991, the respondent insisted on immediate kidney transplant even though the appellant had advised him that in view of his blood and urine infection no transplant could take place for six weeks — on 14.6.1991, 18.6.1991 and 20.6.1991 the respondent received haemodialysis at Nanavati Hospital and allegedly did not complain of deafness during this period — the blood urea of the respondent was found to be 180 mgs.% whereas normally it should not exceed 10-50 mgs.%. This shows that very serious infection in the kidney of the respondent was taking place which required drastic measures — as regards the impairment of hearing of the respondent, there is no known antibiotic drug which has no side effect.
Hence merely because there was impairment in the hearing of the respondent that does not mean that the appellant was negligent. The appellant was desperately trying to save the life of the respondent, which he succeeded in doing. Life is surely more important than side effects — for example many Anti Tubercular drugs (e.g. Streptomycin) can cause impairment of hearing. Does this mean that TB patients should be allowed to die and not be given the Anti Tubercular drug because it impairs the hearing? Surely the answer will be in the negative — the courts and Consumer Fora are not experts in medical science, and must not substitute their own views over that of specialists. It is true that the medical profession has to an extent become commercialized and there are many doctors who depart from their Hippocratic oath for their selfish ends of making money.
However, the entire medical fraternity cannot be blamed or branded as lacking in integrity or competence just because of some bad apples—the appellant was not guilty of medical negligence.
Ajmer, Bikaner will get airports

Devotees headed for the Sufi saint Khwaja Moinuddin Chishti in Ajmer district and Karni Mata temple in Deshnok town in Bikaner district will not have to travel on road — the locations would be connected via air. New airports have been planned and will come up at Bikaner and Kishangarh (in Ajmer) soon. After the new international terminal at the Jaipur airport, the ministry of civil aviation has given nod to develop air strips in Bikaner and Kishangarh into full-fledged airports so that atleast domestic flights could resume there.
Bikaner is known for its ancient havelis, palaces and forts, while Kishangarh is famous for marble and stone business. Kishangarh airport will also provide easy access to holy shrine of Khawaja Moinudin Chisti in Ajmer and the Brahma Temple in Pushkar. Union minister of state for civil aviation Praful Patel on Wednesday announced that foundation stone of Bikaner airport would be laid on March 2. He was in the city to inaugurate the new international terminal of Jaipur airport. Meanwhile, the Airport Authority of India (AII) and the state government singed a memorandum of understanding (MoU) to develop the air strip at Kishangarh into an airport.

Ajmer becomes second home for Rehman
This is a secret Oscar winner A R Rahman did not reveal until a few days after his historic feat. The town of Ajmer, famous worldwide for the dargah of Sufi saint Khwaja Moinuddin Chishti, has become the second home of Rahman and family after Chennai. A strict follower of Khwaja Garib Nawaz, Rahman had been visiting the holy city at least twice a year for the past more than two decades.
Rahman bought the bungalow in Ajmer's satellite area, Kundan Nagar, last November in his mother's name. Even some local residents spoke to Rahman, his mother and sister when they stayed there in November last year for a few days for registering the house, but they didn't recognise him.
It's only after Rahman's Oscar triumph that the people of the area came to know about the owner of the bungalow. Rahman, even otherwise, prefers to keep his identity a secret and prefers to sit with devotees on his visit to the dargah, says Pyare Mohan Tripathi, the district public relations officer.
"Rahman had come here five months back with two women. We came to know that he bought the bungalow, in the name of his mother, Kareema Begum,'' says C D Joshi, Rehman's neighbour. He says, "They stayed there for a couple of days and were busy visiting the dargah. One of the women spoke to me for a few minutes. It was then we came to know a south Indian family had come to live here. She was soft spoken and religious. We never expected she could be the sister of Rahman,'' said 60-year-old Sunita Goyal, a resident of Kundan Nagar.
The three-storeyed bungalow No 16 bought by Rahman has a big porch and a garden. It is surrounded by a 10-foot wall with a big iron gate. "People who live in this area are peace-loving and confined to themselves. Therefore, quite often people do not know who is living three doors away from them,'' says Laxmi Devi, who runs a laundry in the area. The colony is just 5 km from the dargah.
The bungalow originally belonged to S K Dalmiya, a resident of Aurangabad in Maharashtra. "Dalmiya met Rahman some time back and told him that he has a house at Ajmer. He even arranged the accommodation for Rahman and his family members when they visited Ajmer in November. Just after a day's stay, they decided to buy it,'' says Joshi.
The bungalow has two well-furnished bedrooms, a dining room and drawing room. The housekeeper Shanker says, "Rahman Saheb and his mother and sister have come here twice.'' He says he was engaged by Dalmiya to take care of the house. There are two chowkidars.
